Terms of Service

Welcome to Data Syndicate. This Terms of Service Agreement (“Agreement”) outlines the terms and conditions governing your access to and use of products and services provided by Arch Data Solutions, LLC, dba Data Syndicate (“we,” “us,” or “our”). By accessing or purchasing our products and services, you (“you,” “user,” or “Buyer”) agree to comply with this Agreement.

ARTICLE I – Definitions

  • Data Syndicate: Arch Data Solutions, LLC.

  • Buyer: User or entity purchasing products/services.

  • Data: Enhanced public record information provided.

  • License Term: Specified period of licensed access.

  • Products and Services: All provided Data, Information, platforms, and related offerings.

ARTICLE II – License & Usage

License Grant

We grant you a limited, non-transferable license to access our Data for internal business use during your active License Term.

Acceptable Use

You agree:

  • To comply with all applicable laws.

  • Not to share, resell, or sublicense our Data.

  • Not to engage in disruptive or illegal activities.

  • Not to violate privacy or rights of third parties.

Restrictions

We reserve the right to audit compliance with this Agreement. Non-compliance may result in license termination without refund.

ARTICLE III – Intellectual Property

All trademarks, logos, and intellectual property related to Data Syndicate remain exclusively ours. Use of these is prohibited without explicit written consent.

ARTICLE IV – Payments & Billing

  • Pricing is subject to change but will not affect existing active licenses.

  • Accepted payment methods include credit card or financing options through Affirm.

  • Fees paid are non-refundable except as explicitly provided herein.

Refund Policy

Refunds are available only if:

  • You request cancellation before the first Data delivery.

  • Refunds outside the scope above will be subject to the owner’s discretion.

ARTICLE V – Privacy, Data Protection, and Marketing

By using our products, you agree to our Privacy Policy, including optional email/SMS marketing consent. You acknowledge marketing consent is not a purchase condition.

You must independently ensure compliance with applicable marketing laws (e.g., TCPA, CAN-SPAM Act). We accept no liability for violations arising from your use of Data provided.

ARTICLE VI – Termination & Account Management

Either party may terminate this Agreement at any time:

  • We may terminate without notice for violations of this Agreement, and no refunds will be provided for violators.

  • You may cancel by contacting customer support via email at support@thedatasyndicate.io. Refunds will only be provided before the receipt of the first Data delivery.

Account Pause

You may pause your license by contacting our support team via email at support@thedatasyndicate.io. Restrictions apply:

  • Quarterly: No pauses allowed.

  • Semi-Annual: One pause up to 30 days.

  • Annual: Two pauses up to 30 days each. Paused accounts will resume automatically after the pause duration unless canceled by you.

ARTICLE VII – Third-Party Services

We provide references to third-party services but are not responsible for their quality or reliability. You are responsible for reviewing and complying with third-party terms and privacy policies.

ARTICLE VIII – Indemnification & Liability

You agree to indemnify us against any claims, losses, or damages arising from:

  • Your use of our products/services.

  • Non-compliance with this Agreement or applicable laws.

Limitation of Liability

Our liability for damages related to this Agreement is limited to fees paid within the past 12 months. We are not liable for indirect, incidental, special, or consequential damages.

ARTICLE IX – Dispute Resolution

Disputes will be governed by the laws of Wyoming. You agree to resolve disputes exclusively through binding arbitration in Sheridan County, Wyoming, waiving rights to participate in class-action lawsuits.

ARTICLE X – Miscellaneous

  • Severability: Invalid provisions will not affect remaining terms.

  • Assignment: You may not transfer rights without our written consent.

  • Survival: Provisions regarding intellectual property, liability, indemnification, and data protection survive termination.

  • Updates: We may modify this Agreement at any time. Updates will be made available via our website. Continued use constitutes consent to changes.
